If you believe that you were erroneously denied eligibility for Medicaid benefits, the Medicaid system provides for an appeals process. You may submit additional documentation and request a reconsideration and/or request a Fair Hearing. Ultimately, you may also commence a court proceeding to enforce your rights.

The Medicaid appeals process is complex and guided by strict time frames. It is therefore advisable to seek the advice of an Elder Law Attorney to appeal a Medicaid determination to ensure that you obtain the benefits to which you are entitled
